Acceptance of Terms
By accessing or using the services provided by Basketball HQ, you agree to be bound by these Terms and Conditions. Upon entering Basketball HQ, all individuals implicitly accept the terms and conditions. If you do not agree with any part of these terms, we will not be able to offer our services.
Code of Conduct
I agree upon booking or entering the Basketball HQ facility, I will adhere to the rules and guidelines in place. I recognize that failure to do so may result in removal, or suspension from the venue. Actions resulting in removal from the premises will include; vandalism, inappropriate language, misuse of equipment, physical violence, or intimidating mistreatment of staff, disturbing the peace or abuse of other members or customers of any form.
There is a zero-tolerance policy for the following and is not limited to:
- Physical violence
- Inappropriate language
- Inappropriate gestures
- Inappropriate hand signals
- Bullying
- Vandalism
- Stealing
- Abuse of any kind
- Sexual conduct
Note: Basketball HQ reserves the right to use its discretion when determining, what relates to behavior and the severity of the act.
Confidentiality
I recognize that anything you share with us is regarded as confidential, whether it is business or personal information. We undertake not to, at any time, either directly or indirectly, use or disclose any information you share with us.
Privacy Policy
Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our services, you agree to the terms outlined in our terms and Conditions.
Media Release
I authorize and grant Basketball HQ to take photographs and videos regarding my experiences with them.
I grant Basketball HQ to use my photographs and videos on Facebook, Instagram and all social media platforms.
I allow Basketball HQ to edit, alter, copy, or distribute the photographs and videos for social media advertising and marketing.
I agree that the photographs and videos belong to Basketball HQ.
I understand that I will not receive any monetary compensation.
Payments
I acknowledge that all online payments, direct debits, and credit card transactions will be made via Payrix / Perfect Gym platforms. I agree to their terms and conditions and acknowledge that the transaction fees are set by Payrix.
I accept that failure to make payment or failure to have sufficient funds available at the time of the transactions that I may be liable for additional fees and charges at the full discretion of Payrix and/or Basketball HQ.
Memberships
I agree that upon purchasing a membership I am abiding by the Basketball HQ terms and conditions, and agree to make all necessary payments as required. All memberships for a junior must be purchased by an adult / guardian.
I agree that upon purchasing any memberships that there is a minimum 3 month agreement.
Cancellations: I agree to provide a minimum one month notice on the cancellation of any membership. I agree that 25% of the monies remaining under the agreed minimum term commitment will not be refundable. The non-refundable monies cover business and administration costs incurred.
Bookings: I accept that sessions cannot be made further than two weeks in advance. I understand that all bookings should be made via the Basketball HQ/Perfect Gym platform.
Cooling-off Period
Members have a forty-eight-hour “cooling-off period” upon signing their membership agreement. Members can cancel their membership during this period, with a written notice emailed to Basketball HQ. Basketball HQ reserves the right to charge the appropriate fees throughout the commitment period.
Access Fob
Replacement access fobs will have a $50 charge.
Changes in Fees
Basketball HQ reserves the right to change pricing. Members will be notified of the changes, members reserve the right to terminate their membership within fourteen days of being notified. Members who don’t opt into termination will be required to pay the new rates moving forward.
Member Termination
Termination enquires must contact Basketball HQ via info@basketball-hq.com.au
Any and all terminations require a one-month notice period. Members must also return their access fob to avoid a $50 replacement fee. Basketball HQ reserves the right to use its discretion in determining members reasonings and evidence.
Only Basketball HQ coaching staff are permitted to coach in the facility or by prior arrangements.
Facility Entry
Tailgating
Basketball HQ members are allowed to enter the facility. If a member assists an individual without a membership into Basketball HQ, they will be deemed as “tailgating” breaking membership terms and conditions. This may result in membership coming under review and a fine up to $200 may apply.
Lending
Memberships are individualised and cannot be used by anyone else under any circumstances, if members are caught lending people their access fob to enter the facility, they will be deemed as breaking these terms and conditions. This may result in membership coming under review and a fine up to $200 may apply.
Minimum Age
Individuals under the age of seventeen require permission and parental guidance during the sign-up process, the sign-up process must be completed in person and by someone older than seventeen. Individuals over the age of 13 are eligibly for 24/7 access. Parents or guardians, by signing these terms you agree to allow this member 24/7 access to Basketball HQ at their own risk.
Cancellations
I agree to provide a minimum of 24 hours’ notice for any cancellation to a booking, and failure to do so will mean the loss of monies or credit. (We do not provide refunds) Cancellations that are communicated more than 24 hours before the start of the booking can be rescheduled without loss of funds.
Upon signing these terms members, parents, guardians, and visitors understand that Basketball HQ and certain services, may be unavailable during certain periods of time for things such, but not limiting to: prior bookings, events, natural disasters, fires or any other reasons. Furthermore, Basketball HQ reserves the right to eliminate any services or resources they provide members. Members will be notified should any of the above situations occur.
Members understand that shooting lanes may sometimes be unavailable at certain periods of time. To ensure availability members are encouraged to book ahead of time online, failure to book may result in little to no vacancy.
Gym
I understand that anyone under the age of 13 years or younger that are not having a PT session or 1 on 1 are required to have a parent or guardian with you at all times.
Orientation & Induction
I agree to undertake onsite orientation and induction with a Basketball HQ team member to ensure I understand the safe and appropriate use of all equipment and technology including our gym.
Transfer of Memberships
I accept that I cannot transfer any funds, credits or bookings to any other individual, including family members and friends. If found to do so may result in loss of membership, suspension from venue, at the discretion of Basketball HQ
General
I agree that Basketball HQ may in our absolute discretion, change these terms and conditions from time to time without notice to you, and acknowledge that if any part of these terms and conditions are void, then the part that is void may be severed.
Waiver
I hereby give approval for myself and/or child to participate in any and all activities prepared by Basketball HQ. In exchange for the acceptance of myself and/or said child’s candidacy by Basketball HQ, I assume all risk and hazards incidental to the conduct of the activities, and release, absolve and hold harmless Basketball HQ, and all its respective officers, agents, and representatives from any and all liability for injuries to said child arising out of traveling to, participating in, or returning from academy sessions.
I understand and voluntarily accept the risk and agree that Basketball HQ will not be liable for any injury including without limitation, personal, bodily or mental injury and economic loss. I consent to and authorize Basketball HQ to administer or arrange for appropriate medical treatment in circumstances. Where it is necessary.
I understand that Basketball HQ has the right to evict anyone who:
Has failed to follow the reasonable directions of the representative; or presents a hazard to the safety and wellbeing of any person including themselves.
Basketball HQ may monitor the facility to ensure all customers and staff safety and compliance with the agreement.
The Users must comply with all signs or other directions of Basketball HQ and it may suspend or cancel the users session and/or membership and be removed from site for non-compliance with these conditions or for reckless or careless conduct to the facility and be responsible for any damages that occur within the facility through reckless conduct.
I understand that Basketball HQ, or employees, representatives, independent contractors working for or in partnership with Basketball HQ and the facility cannot be held responsible in whole or in part for any accidents, illness or injuries resulting in medical or dental expenses incurred from attending Basketball HQ.
I agree to waiver my rights to any and all claims, costs, liabilities and injuries incurred while within the venue. I agree to assume full and complete responsibility for any and all medical bills arising from attendance at the venue. In the event of any emergency, I authorize Basketball HQ to exercise its judgment in the treatment by a medical authority.
Medical Conditions
Any form of physical activity within the facility may involve the risk of injury and you exercise at your own risk. We advise consulting a medical professional before taking part in physical activities within Basketball HQ, individuals are responsible for monitoring their own health conditions and are advised to listen to their medical professional. Should an individual experience any concerning health symptoms, you are required to stop and notify a staff member immediately.
By consenting to our T&C’s you agree to be forthcoming with any pre-existing or new medical conditions and/or injuries. Failure to communicate any condition, will waiver any liability on Basketball HQ.
Basketball HQ will not be held liable for any injury, serious injury or death which occurs while engaging in exercise or other activities at Basketball HQ, unless its caused by our gross negligence.
GOVERNING LAW
This Waiver will be governed by and construed in accordance with the laws of the State of Queensland.
By checking the appropriate box during the membership sign up process in Perfect Gym, you agree and consent to any and all causes on this waiver. You also consent to have legally signed this document by checking the correct box on Perfect Gym. Non members by physically signing this document in person through our website, you are consenting to these terms and conditions.
